Welcome to Pet Supply Club. These Terms & Conditions (“Terms”) apply to your use of https://petsupplyclub.ca (the “Site”) and to every purchase you make from us. The Site is operated by 1612197 B.C. Ltd., doing business as Pet Supply Club (“Pet Supply Club”, “we”, “us” or “our”), 15738 106 Ave, Surrey, BC V4N 1K5, Canada.

By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least the age of majority in your province or territory of residence to place an order, or have the permission of a parent or guardian who agrees to these Terms on your behalf.

2. Products and Information

We do our best to describe and display our products accurately, including sizes, ingredients, colours and images. Product packaging may change from time to time, and colours can look different depending on your screen. We do not guarantee that every description is complete, error-free or current.

Our products are pet supplies, not veterinary treatment. Information on the Site is for general guidance only and is not a substitute for advice from a licensed veterinarian. Always follow the manufacturer’s directions and supervise your pet with new food, treats and toys.

3. Pricing and Taxes

All prices are shown in Canadian dollars (CAD) unless stated otherwise. Applicable taxes (GST, PST or HST, depending on your delivery address) and shipping charges are added at checkout.

Prices and availability can change without notice. If a product is listed at an incorrect price because of a typing, pricing or system error, we may cancel any order placed at that price. If your payment has already been taken, we will refund it in full.

4. Orders

Your order is an offer to buy. We accept it when we ship the item and send you a shipping confirmation. We may refuse or cancel any order, or limit quantities, for reasons including stock availability, errors in product or pricing information, or suspected fraud. If we cancel an order after you have paid, we will refund you in full.

5. Payment

We accept the payment methods shown at checkout. Payment is taken when you place your order. See our Credit Card Policy for details on how card payments are handled.

6. Shipping, Returns and Refunds

Delivery is covered by our Shipping Policy. Returns, exchanges and refunds are covered by our Refund & Return Policy. Both form part of these Terms.

7. Your Account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please let us know right away if you believe your account has been used without your permission.

8. Acceptable Use

You agree not to use the Site for any unlawful purpose; to attempt to gain unauthorized access to the Site or its systems; to interfere with the Site’s operation; or to copy, scrape or resell Site content without our written permission.

9. Reviews and Submissions

If you post a review, comment or other content, you confirm it is your own, is accurate, and does not break any law or anyone’s rights. You give us a non-exclusive, royalty-free licence to use, display and reproduce it in connection with our business. We may remove any content at our discretion.

10. Intellectual Property

All content on the Site, including text, graphics, logos, images and software, belongs to Pet Supply Club or its licensors and is protected by Canadian and international intellectual property laws. Brand names of products we sell belong to their respective owners.

11. Third-Party Links

The Site may link to websites we do not control. We are not responsible for their content or practices.

12. Disclaimer

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded under applicable consumer protection law. Manufacturer warranties, where offered, are provided by the manufacturer.

13. Limitation of Liability

To the fullest extent permitted by law, Pet Supply Club will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.

14. Indemnity

You agree to indemnify and hold harmless Pet Supply Club and its directors, employees and agents from any claims arising from your breach of these Terms or your misuse of the Site.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. You agree to the jurisdiction of the courts of British Columbia, without affecting any right you may have to bring a claim in your own province or territory under its consumer protection laws.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Orders are governed by the Terms in effect when the order was placed.
